Acceptance and eligibility

These Terms of Use (“Terms”) are an agreement between you and 717apps, LLC (“BrainWins,” “we,” “us,” or “our”). They govern your access to and use of the BrainWins mobile application, the website at brainwins.app, and related services (collectively, the “Service”).

By downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to create a BrainWins account. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms on your behalf. You may not use the Service if applicable law prohibits you from doing so.

What BrainWins provides

BrainWins is a digital wellbeing and focus tool that can help you:

• Select apps, app categories, and websites through Apple’s private Family Activity Picker.
• Create reusable modes, schedules, limits, and protection levels.
• Start timed Focus Runs and apply Apple Managed Settings shields.
• Track protected time, Daily Wins, streaks, BrainScore, Time Won, and BrainDrive progress.
• Use optional accounts, challenges, leagues, and community features when available.

Some functionality requires a compatible Apple device, a supported operating-system version, Screen Time authorization, an internet connection, an Apple ID, or optional account sign-in. Features may vary by device, country, app version, entitlement availability, or beta status.

Screen Time authorization and blocking

You control whether to grant Screen Time authorization and which items to protect. BrainWins is intended for self-directed focus and individual authorization. You may not use BrainWins to secretly monitor, control, or interfere with another person’s device or activity.

Blocking depends on Apple frameworks, system permissions, device state, operating-system behavior, schedules, and configuration. No software can guarantee uninterrupted blocking in every circumstance. System updates, permission changes, device restarts, app removal, entitlement changes, or Apple service behavior may affect protection.

You remain responsible for important deadlines, alarms, communications, emergency access, device configuration, and any decision to use stricter protection modes. BrainWins is a focus aid, not an emergency, safety, medical, parental-control, or mission-critical service.

Your license to use BrainWins

Subject to these Terms, BrainWins grants you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service for lawful, noncommercial purposes on devices you own or control.

BrainWins is licensed, not sold. For copies obtained through Apple’s App Store or TestFlight, Apple’s Standard Licensed Application End User License Agreement also applies unless a custom license is presented through Apple. If these Terms conflict with Apple’s mandatory terms, Apple’s terms control to the extent of the conflict.

You may not copy, distribute, sell, sublicense, rent, reverse engineer, decompile, attempt to extract source code, bypass technical restrictions, or create derivative works of BrainWins except where applicable law expressly permits it despite this restriction.

Accounts and account security

Core local blocking may be used without a cloud account. Optional cloud and community features may require Sign in with Apple or another supported authentication provider.

You are responsible for maintaining the security of your device, Apple account, authentication credentials, and BrainWins account. Provide accurate information, keep it current, and promptly notify us if you believe your account has been accessed without authorization.

You may not impersonate another person, create accounts to evade enforcement, sell or transfer an account, or use automated methods to create or access accounts. We may restrict or suspend access when reasonably necessary to protect users, investigate abuse, comply with law, or maintain service integrity.

You can initiate permanent cloud-account deletion from Profile & Settings → Delete Cloud Account. Deleting your BrainWins account does not automatically cancel an App Store subscription; subscriptions must be managed through Apple.

Community features and acceptable conduct

If you opt into profiles, leagues, challenges, reports, or other community features, you agree to treat others respectfully and use those features honestly.

You may not:

• Harass, threaten, discriminate against, stalk, exploit, or impersonate another person.
• Submit unlawful, deceptive, obscene, infringing, or malicious profile information or content.
• Manipulate protected-time totals, Focus Run records, ranks, challenge results, achievements, or rewards.
• Use modified software, automation, fabricated events, or unauthorized interfaces to access or influence the Service.
• Probe, disrupt, overload, damage, or circumvent security, rate limits, permissions, or access controls.
• Collect or attempt to identify another user’s private activity or Screen Time selections.

We may investigate reports and remove content, restrict visibility, disqualify results, suspend accounts, or terminate access when we reasonably believe these Terms have been violated. We do not guarantee that every report will result in action or that community features will always be available.

Scores, progress, challenges, and rewards

BrainScore, Drive XP, levels, streaks, Time Won, league results, challenge progress, achievements, and rewards are app features intended for motivation and entertainment. They have no cash value, are not transferable property, and may not be sold or exchanged.

We may correct inaccurate results, change formulas, rebalance thresholds, reset beta or preseason data, revoke improperly obtained rewards, or modify competitive formats to preserve fairness and service integrity. Local previews may differ from server-verified competitive results.

Time Won is an estimate based on complete-day comparisons to your private local baseline. It is not a guarantee of productivity, health improvement, financial value, or a specific real-world outcome.

App Store purchases and subscriptions

If BrainWins offers paid features, prices, billing periods, free trials, included benefits, and renewal terms will be shown before purchase. Purchases are processed by Apple and are subject to Apple’s media-services and payment terms. We do not receive your full payment-card details.

Auto-renewable subscriptions renew unless canceled through your Apple account before renewal. You can manage or cancel subscriptions at Apple’s subscription-management page. Deleting BrainWins or deleting your BrainWins account does not by itself cancel an Apple subscription.

Refund requests are handled under Apple’s applicable policies. BrainWins requires an active subscription after onboarding, but access will not be conditioned on granting access to unrelated personal data.

Third-party and Apple services

The Service relies on or may link to services operated by others, including Apple platform services and Supabase cloud infrastructure. Their services are governed by their own terms and privacy policies. We are not responsible for third-party services outside our control, but we select and configure service providers with the goal of protecting BrainWins data as described in our Privacy Policy.

Apple is not responsible for providing maintenance or support for BrainWins except as required by applicable Apple terms. Apple and its subsidiaries are third-party beneficiaries of the Apple-required license terms and may enforce those terms against you.

Ownership and feedback

BrainWins, including its software, visual design, BrainDrive world, artwork, branding, text, systems, and other content, is owned by 717apps, LLC or its licensors and is protected by intellectual-property laws. These Terms do not transfer ownership of BrainWins or our trademarks to you.

If you voluntarily provide ideas, suggestions, or beta feedback, you grant us permission to use that feedback without restriction or compensation. This does not transfer ownership of personal information or content you submit for support or account purposes.

Changes, availability, and beta features

We may add, change, suspend, or discontinue features; impose reasonable limits; or release updates needed for security, compatibility, or product development. We will not intentionally remove paid access you are legally entitled to without providing the remedy required by applicable law or App Store rules.

Beta and TestFlight versions may contain errors, incomplete features, temporary data, or experimental scoring. Beta data may be reset before public release. Do not rely on beta software for critical activity, and keep your device and important information appropriately backed up.

Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, uninterrupted availability, and freedom from errors. We do not guarantee that blocking will be uninterrupted or that using BrainWins will produce a particular habit, productivity, wellbeing, or Screen Time outcome.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted, and your mandatory consumer rights remain unaffected.

Limitation of liability

To the maximum extent permitted by law, 717apps, LLC and its members, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, goodwill, or opportunities; device interruption; missed communications; or damages resulting from your use of or inability to use the Service.

To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid to BrainWins during the twelve months before the event giving rise to the claim or fifty U.S. dollars (US $50). These limits do not apply where prohibited by law or to liability that cannot legally be limited.

Suspension and termination

You may stop using BrainWins at any time and may delete your cloud account through the app. We may suspend or terminate access if you materially violate these Terms, create risk or legal exposure, manipulate the Service, harm other users, or if continued operation is no longer commercially or technically reasonable.

Where practical, we will provide notice and an opportunity to appeal, unless immediate action is reasonably necessary for safety, security, fraud prevention, legal compliance, or preventing ongoing harm. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, and dispute provisions—will survive.

Applicable law and resolving concerns

Before filing a formal claim, please contact us and describe the issue so we can try to resolve it informally. These Terms are governed by applicable law, without limiting any mandatory consumer protections or rights that apply in the jurisdiction where you live.

If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, reorganization, financing, or transfer of the Service.

Changes to these Terms

We may update these Terms to reflect changes to BrainWins, our business, or legal requirements. The revised Terms will be posted here with a new effective date. When required, we will provide additional notice or request renewed acceptance. Continuing to use the Service after revised Terms take effect means you accept them.
